Terms of Service
Effective May 24, 2026
These Terms of Service ("Terms") govern your use of zevsend ("the service," "we," "us"). By creating an account or sending a message through our API, you agree to these Terms and the Acceptable Use Policy, which is incorporated by reference.
1. Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract. You're responsible for keeping your account credentials, API keys, and domain-verification material secure. Notify us immediately at security@zevsend.com if you suspect compromise.
2. The service
We provide a transactional messaging API (email, SMS, WhatsApp, verification codes) and the dashboard tools needed to operate it. The service is provided on an as-available basis. Specific deliverability outcomes depend on factors outside our control (recipient mailbox rules, regional SMS carrier behaviour, sender reputation), but we engineer the platform to maximise them.
3. Acceptable Use
Your use of the service must comply with our Acceptable Use Policy. Violations may result in suspension or termination of your account.
4. Fees
Plans and pricing are published in the dashboard. Fees accrue as you send. Free-plan accounts have usage limits. We may change pricing with 30 days' notice via email; existing committed terms (where applicable) are honoured through their current cycle.
5. Data ownership
You own the message content and recipient data you send through the service. We process it on your behalf as a service provider / data processor as defined by applicable law. You're responsible for having a lawful basis to send to your recipients.
We don't use your message content or recipient data to train machine-learning models, nor share it with third parties beyond upstream delivery carriers and infrastructure providers acting under data-protection contracts.
6. Confidentiality
Both parties keep each other's confidential information confidential and use it only as needed to operate this agreement.
7. Suspension and termination
We may suspend or terminate your account if:
- You materially breach these Terms or the AUP and don't cure within 7 days of notice. If the breach cannot be cured (abuse, illegal content, security threats), we may act immediately.
- Your messaging activity creates substantial deliverability or compliance risk for the platform.
- We're required to do so by law or by an upstream provider.
You can terminate at any time by closing your account in the dashboard. Outstanding fees up to the termination date are payable.
8. Warranties
Each party warrants it has the authority to enter this agreement and will comply with applicable law. We warrant the service is provided with reasonable care and skill consistent with industry standards. Beyond that, the service is provided "as is" and we disclaim all other warranties to the maximum extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose.
9. Liability
Neither party is liable for indirect, consequential, incidental, or punitive damages. Each party's aggregate liability for any claim is capped at the fees paid by you to us in the 12 months preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be limited under applicable law (gross negligence, wilful misconduct, fraud, death or personal injury).
10. Indemnity
You'll defend and indemnify us against claims arising from your breach of these Terms or the AUP, the content of messages you send, or your use of the service in violation of law.
11. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes go to the courts of Lagos, Nigeria. If you're contracting from the EU/UK, this is without prejudice to any mandatory consumer-protection rights in your country of residence.
12. Changes
Material changes to these Terms are announced via email at least 30 days before they take effect. Continued use after that date constitutes acceptance. If you don't accept, you can terminate without penalty before the change takes effect.
